Effective October 1, 2026
These Terms govern your use of NEXOLUME LLC’s website and services. Project-specific proposals, statements of work, order forms or written agreements may contain additional terms and will control for that project where they conflict with these general Terms.
Services
NEXOLUME LLC provides custom computer programming, software development, AI and automation solutions, digital platforms, NFC solutions and related technology services. Scope, deliverables, timelines and pricing are defined in the applicable quote or agreement.
Customer responsibilities
Customers must provide accurate information, required access and timely feedback, and must not use our services for unlawful, fraudulent, abusive or infringing activities.
Fees and payments
Fees and payment schedules are stated in the applicable quote, invoice or agreement. Taxes, when applicable, may be added as required by law. Overdue balances may delay work or access to services.
Intellectual property
Ownership of custom deliverables is governed by the applicable project agreement. NEXOLUME LLC retains ownership of pre-existing tools, reusable components, know-how and materials unless expressly transferred in writing.
Third-party services
Some solutions may depend on third-party platforms, APIs, hosting providers or other services. Their availability and separate terms are outside our direct control.
Warranties and liability
Services are provided with reasonable professional care. Except where prohibited by law or expressly stated in writing, services are provided without additional warranties. Liability is limited to the maximum extent permitted by applicable law and any project-specific agreement.
Termination
Either party may terminate a project or recurring service according to the applicable written agreement or cancellation policy. Amounts due for work already performed remain payable unless otherwise required by law.
Governing law
Unless a separate written agreement states otherwise, these Terms are governed by the laws applicable to NEXOLUME LLC in the State of New Mexico, United States, without regard to conflict-of-law principles.
